(c) Sentencing- the Court shall consider all the facts and circumstances of the conviction while deciding the sentence. (1) The minimum sentence for a conviction of criminal homicide is 1 year in jail and a $5000 fine. (2) The maximum sentence for a conviction of criminal homicide is the maximum punishment allowed under federal law at the time of the conviction and any of the following; (A) The Court may recommend to the Spokane Tribal Business Council disenrollment of the convicted member; and (B) Banishment of the convicted individual from the Reservation and all Tribal properties. Section 8-12 Robbery 8-12.01 Robbery (a) A person commits robbery when he unlawfully takes personal property from the person of another or in his presence against his will by the use or threatened use of immediate force, violence, or fear of injury to that person or his property or the person or property of anyone. Such force or fear must be used to obtain or retain possession of the property, or to prevent or overcome resistance to the taking; in either of which cases the degree of force is immaterial. Such taking constitutes robbery whenever it appears that, although the taking was fully completed without the knowledge of the person from whom taken, such knowledge was prevented by the use of force or fear. (b) Sentencing- the Court shall consider all the facts and circumstances of the conviction while deciding the sentence. (1) The minimum sentence for a conviction of robbery is 6 months in jail and a $500 fine.
