lawful requirements of any one or combination of federal and/or provincial
authorities;
(c)
if the Grantor passes and attempts to enforce against Hydro any law,
regulation, standard or requirement in relation to the Works or its rights under
this Agreement that is in excess of any federal or provincial law, regulation or
prevailing industry standard, and which results in a material increase to any or
all of Hydro’s costs than Hydro would otherwise incur in respect of all
activities or things necessary or incidental to the business of Hydro and
operation of the Works pursuant to this Agreement, then the Grantor shall
indemnify and hold harmless Hydro for any additional costs required or
incurred to comply with such law, regulation, standard, or requirement;
(d)
the Grantor will not permit or make, place, erect, operate, use or maintain any
building, structure, foundation, pavement, excavation, well, fill, pile of
material, obstruction, equipment, thing or inflammable substance, or plant any
vegetation upon the Area of the Works, if any such action or thing, in the
reasonable opinion of Hydro:
(i)
may interfere with or endanger the Works or any part thereof or the
installation, operation, maintenance, removal or replacement of the
Works or any part thereof;
(ii)
may obstruct access to the Works or any part thereof by those
authorized by Hydro; or
(iii)
may by its operation, use, maintenance or existence on the Area of the
Works, create or increase any hazard to persons or property in relation
to the Works;
(e)
the Grantor will not diminish or increase the ground elevation in the Right of
Way Area by any method, including piling any material or creating any
excavation, drain, or ditch in the Right of Way Area, unless permission in
writing from Hydro has first been received, which permission will not be
unreasonably withheld, conditioned or delayed;
(f)
the Grantor will not carry out blasting or aerial logging operations on or
adjacent to the Area of the Works without prior written permission from
Hydro, in its sole discretion;
(g)
the Grantor will not use or authorize the use of the portions of the Right of
Way Area for the regular, or organized parking of vehicles without the prior
written permission from Hydro, in its sole determination, provided that
nothing in this subsection is intended to prevent safe temporary parking of
vehicles;
(h)
the Grantor will not park, or authorize to be parked on the Right of Way Area
any vehicle or equipment if the parking of such vehicle does not comply with
