Kitsumkalum Agreement-in-Principle
101.
Paragraph 100 does not apply if the Kitsumkalum Child has reached the age where consent to
adoption is required under Provincial Law and objects to the discussion taking place, or if the
birth parent or other guardian of the Kitsumkalum Child who requested that the Kitsumkalum
Child be placed for adoption objects to the discussion taking place.
Child Care
102.
The Kitsumkalum Government may make laws in respect of Child Care services on
Kitsumkalum Lands.
103.
Federal Law or Provincial Law prevails to the extent of a Conflict with Kitsumkalum Law made
under paragraph 102.
Language and Culture Education
104.
The Kitsumkalum Government may make laws applicable on Kitsumkalum Lands in respect of:
a)
b)

the education of Sm’algyx language and Tsimshian culture provided by a Kitsumkalum
Institution, including:
i)
the certification and accreditation of teachers of Sm’algyx language and
Tsimshian culture;
ii)
the development and teaching of Sm’algyx language and Tsimshian culture
curriculum; and
the preservation, promotion and development of Sm’algyx language and Tsimshian
culture.
Kitsumkalum Law under paragraph 104 prevails to the extent of a Conflict with Federal Law or
Provincial Law.
Kindergarten to Grade 12 Education
106.
The Kitsumkalum Government may make laws in respect of kindergarten to grade 12 education
provided by a Kitsumkalum Institution on Kitsumkalum Lands.
107.
Kitsumkalum Law under paragraph 106 will:
a)
establish curriculum, examination and other standards that permit the transfer of students
between school systems at a similar level of achievement and permit entry of students to
the provincial post-secondary education systems; and
b)
provide for the certification, other than for the teaching of Sm’algyx language and
culture, of teachers by a Kitsumkalum Institution, or a body recognized by British
Columbia in accordance with standards comparable to standards under Provincial Law
applicable to individuals who teach in public or provincially funded independent schools
in British Columbia.
108.
The Kitsumkalum Government may make laws in respect of home education of Kitsumkalum
Members on Kitsumkalum Lands.
109.
Kitsumkalum Law under paragraphs 106 and 108 prevails to the extent of a Conflict with
Federal Law or Provincial Law.
