Kitsumkalum Agreement-in-Principle 110. At the request of Kitsumkalum or British Columbia, Kitsumkalum and British Columbia will negotiate and attempt to reach an agreement concerning the provision of kindergarten to grade 12 education by a Kitsumkalum Institution to: a) persons other than Kitsumkalum Children residing on Kitsumkalum Lands; or b) Kitsumkalum Children residing off Kitsumkalum Lands. Post Secondary Education 111. 112. The Kitsumkalum Government may make laws in respect of post-secondary education provided by a Kitsumkalum Institution on Kitsumkalum Lands, including: a) the establishment of post-secondary institutions with the ability to grant degrees, diplomas or certificates; b) the determination of the curriculum for post-secondary education institutions established by the Kitsumkalum Government; and c) the provision for and coordination of adult education programs. Federal Law or Provincial Law prevails to the extent of a Conflict with Kitsumkalum Law under paragraph 111. Solemnization of Marriages 113. The Kitsumkalum Government may make laws in respect of solemnization of marriages in British Columbia by individuals designated by the Kitsumkalum Government. 114. Individuals designated by the Kitsumkalum Government to solemnize marriages: 115. a) will be appointed by British Columbia as persons authorized to solemnize marriages; and b) have the authority to solemnize marriages under Provincial Law and Kitsumkalum Law, and have all the associated rights, duties and responsibilities of a marriage commissioner under Provincial Law. Federal Law or Provincial Law prevails to the extent of a Conflict with Kitsumkalum Law under paragraph 113. Liquor Control 116. The Kitsumkalum Government may make laws in respect of prohibition of, and the terms and conditions for, the sale, exchange, possession, manufacture or consumption of liquor on Kitsumkalum Lands. 117. Federal Law or Provincial Law prevails to the extent of a Conflict with Kitsumkalum Law under paragraph 116. 118. British Columbia will approve all applications made by or with the consent of the Kitsumkalum Government for licenses or permits to sell liquor on Kitsumkalum Lands, where the proposed sale complies with applicable Provincial Law. 119. British Columbia will not issue a license, permit or other authority to sell liquor on Kitsumkalum Lands without the consent of the Kitsumkalum Government. 120. A person with a licence, permit, or other authority to sell liquor on Kitsumkalum Lands must purchase liquor from the British Columbia Liquor Distribution Branch or from any person Page 101 of 140
