Kitsumkalum Agreement-in-Principle “Kitsumkalum Corporation” means a corporation that is incorporated under Federal Law or Provincial Law, all of the shares of which, except any qualifying shares that directors are required to own under Federal Law or Provincial Law, are owned legally and beneficially by: a) Kitsumkalum; b) one or more Kitsumkalum settlement trusts; c) one or more corporations where each such corporation is itself a Kitsumkalum Corporation; or d) any combination of Persons set out in (a), (b) and (c). “Kitsumkalum Family” means a family where one or both parents or guardians live together with one or more Children and: a) at least one of the parents or guardians is a Kitsumkalum Member; or b) at least one of the Children is a Kitsumkalum Child. “Kitsumkalum Government” means the government of Kitsumkalum. “Kitsumkalum Institution” means the Kitsumkalum Government or a Kitsumkalum Public Institution. “Kitsumkalum Lands” means those lands identified in Appendix B. “Kitsumkalum Law” means a law made pursuant to Kitsumkalum law-making authority set out in the Final Agreement and includes the Kitsumkalum Constitution. “Kitsumkalum Member” means an individual who is enrolled under the Final Agreement in accordance with the Eligibility and Enrolment Chapter. “Kitsumkalum Private Lands” means those Kitsumkalum Lands that have been designated as Kitsumkalum Private Lands. “Kitsumkalum Project” means a project on Kitsumkalum Lands that is subject to an Environmental Assessment under Kitsumkalum Law but does not include a Provincial Project. “Kitsumkalum Public Institution” means a body, board, commission or any other similar entity established under Kitsumkalum Law, including a school board or health board, but for greater certainty does not include the Kitsumkalum Government. “Kitsumkalum Public Lands” means Kitsumkalum Lands other than Kitsumkalum Private Lands. “Kitsumkalum Public Officer” means: a) a member, commissioner, director, or trustee of a Kitsumkalum Public Institution; b) a director, officer or employee of a Kitsumkalum Corporation whose principal function is to provide public programs or services reasonably similar to those provided by federal, provincial or municipal governments, rather than to engage in commercial activities; c) an officer or employee of the Kitsumkalum Government or a Kitsumkalum Institution; d) an election official within the meaning of a Kitsumkalum Law; or e) a volunteer who participates in the delivery of services by Kitsumkalum, a Kitsumkalum Institution, or a body referred to in (b), under the supervision of an officer or employee Page 12 of 140
